Terms of Use

The terms governing your access to and use of the Notchers mobile app and related services.

1. Agreement to these Terms

Vensio AS makes and releases Notchers, a mobile tally and counting application. These Terms of Use govern your access to and use of Notchers.

By installing, accessing, or using Notchers, you agree to these Terms. If you do not agree, do not use the app.

If you use Notchers on behalf of an organization, you represent that you have authority to accept these Terms for that organization.

2. What Notchers does

Notchers lets you create personal tallies, organize tallies into groups, log count events, view history and statistics, customize display settings, and export your data.

The current Notchers app is a mobile app for personal tally use. It stores tally data locally on your device first. A Notchers account is optional and is used for features that need an account, such as Pro cloud backup and cross-device sync.

Notchers Pro is an optional paid subscription. Pro currently unlocks cloud backup and cross-device sync, unlimited tally and group creation, advanced statistics, and export features.

3. Eligibility

You must be at least 13 years old, or the minimum age required in your country to use online services, to use Notchers. If you are under the age of majority where you live, you may use Notchers only with permission from a parent or legal guardian.

You are responsible for making sure your use of Notchers is lawful where you use it.

4. Accounts and security

Core local counting features do not require an account. Some features, including Pro cloud backup and cross-device sync, require sign-in through a supported authentication provider.

You are responsible for keeping your device, account, and sign-in credentials secure. Actions taken through your device or account may be treated as actions taken by you.

Signed-in users can permanently delete their Notchers account and associated data from Settings > Data > Account. Deleting a Notchers account does not automatically cancel an app store subscription.

Contact contact@vensio.no if you believe your account or access to Notchers has been compromised.

5. Your data and content

You keep ownership of the tallies, groups, event history, notes, amounts, location details, settings, and other content you enter into Notchers.

You grant Vensio AS a limited license to store, process, display, sync, back up, and export that content only as needed to operate Notchers, provide requested features, troubleshoot issues, enforce these Terms, and comply with law.

You are responsible for the accuracy, legality, and appropriateness of the content you enter. Do not enter sensitive personal information unless you are comfortable storing it in the app and, when cloud backup is enabled, syncing it through Notchers infrastructure.

6. Local storage, cloud backup, and exports

Notchers is built around local mobile data. If you delete the app, reset your device, lose your device, or clear local data, local tallies and history may be lost.

Cloud backup, when enabled, is intended to help preserve and sync data for signed-in Pro users, but it is not a guaranteed archival service. Sync may be delayed, interrupted, incomplete, or unavailable.

Export features are provided so you can keep your own copies of your data. You are responsible for storing exported files securely and for choosing where exported files are shared.

7. Subscriptions and paid features

Some features require Notchers Pro. Purchases and subscriptions are processed by the applicable app store and managed through RevenueCat, not directly by Notchers in the app.

Subscriptions may renew automatically unless canceled through your app store account settings before renewal. Refunds, cancellations, billing support, free trials, and purchase disputes are handled under the applicable app store rules.

If your Pro subscription expires, is canceled, or cannot be verified, paid features may become unavailable. Existing local data is not deleted solely because a Pro subscription expires.

8. Acceptable use

You may not use Notchers to break the law, infringe rights, harass others, collect or track people without lawful permission, interfere with the app infrastructure, bypass usage limits, reverse engineer protected parts of the app, or attempt unauthorized access to accounts, data, or systems.

You may not upload, store, or share content that is illegal, harmful, abusive, deceptive, invasive of privacy, or otherwise violates these Terms.

9. No professional advice or critical use

Notchers is a general counting and tally tool. It does not provide medical, legal, financial, safety, compliance, emergency, or professional advice.

Do not rely on Notchers for medication tracking, emergency response, safety-critical operations, regulated records, legal deadlines, financial reporting, or any use where a missed count, delayed sync, software error, or data loss could cause harm.

10. Third-party services and app stores

Notchers may rely on third-party services for authentication, cloud hosting, sync, purchases, subscriptions, app distribution, and related infrastructure. Those services may have their own terms and privacy practices.

If you downloaded Notchers through the Apple App Store, Google Play, TestFlight, or another app store, your use of that store is also governed by that store provider's terms.

For Apple-distributed builds, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as related to your licensed use of the app.

11. Ownership of Notchers

Notchers, including the app design, software, code, branding, text, graphics, and related materials, is owned by or licensed to Vensio AS and is protected by intellectual property laws.

These Terms give you a limited, personal, non-exclusive, non-transferable, revocable license to use Notchers for its intended purpose. You do not receive ownership of the app or any underlying intellectual property.

12. Feedback

If you provide ideas, bug reports, suggestions, or other feedback, you grant Vensio AS permission to use that feedback without restriction or compensation to you.

13. Changes to the app or Terms

Vensio AS may change, suspend, or discontinue features from time to time. These Terms may also be updated from time to time.

If changes are material, Notchers may provide notice in the app, through the app store listing, by email, or by other reasonable means. Continued use after changes become effective means you accept the updated Terms.

14. Termination

Vensio AS may suspend or terminate access to cloud backup or paid features if you violate these Terms, create risk, misuse the service, or if required by law. You may stop using Notchers at any time.

Sections that by their nature should survive termination, including ownership, disclaimers, limitations of liability, and dispute terms, will survive.

15. Disclaimers

Notchers is provided "as is" and "as available." To the fullest extent allowed by law, Vensio AS disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and data preservation.

Vensio AS does not warrant that the app will be uninterrupted, secure, error-free, accurate, compatible with every device, or that data will never be lost or corrupted.

16. Limitation of liability

To the fullest extent allowed by law, Vensio AS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, device issues, service interruption, or substitute services.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including rights that cannot be limited under applicable consumer protection laws.

17. Indemnity

To the extent allowed by law, you agree to defend, indemnify, and hold harmless Vensio AS from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Notchers, your content, your violation of these Terms, or your violation of law or third-party rights.

18. Governing law and disputes

These Terms are governed by the laws of Norway, excluding conflict-of-law rules, unless mandatory consumer protection laws in your country require otherwise.

Before bringing a formal claim, you agree to contact contact@vensio.no and try to resolve the issue informally.
